Just because the tender was acquired for the least amount, doesn't give them a right to degrade services. IR has to pull such non-performers out of service. Such clauses should be added in the tender. Sadly, what happens most of the times is that the tender goes to someone who is politically well connected, who cannot be questioned. This is the root of problems. Privatisation may be a solution to few things, but not everything.
I have said this before and I am reiterating again: Complete privatisation may cause doom of IR gradually. Privatisation should be carried out in such a way that it doesn't harm the existing passenger trains or other services.
